James was born Abt. 1725 in Culpepper County, Virginia, and died March 08, 1790 in Richmond County, Georgia. He married (1) ELIZABETH RUKER Bef. 1748, daughter of JOHN RUCKER. She died Aft. 1790 in Richmond County, Georgia. He married (2) MARY Aft. 1748.

Notes for JAMES ZACHARY:
He first married, before 1748, Elizabeth Rucker, daughter of his father's friend, John Rucker. At that time, James was living on the Plantation in Caroline County, Virginia.

James married the 2nd time to a Mary ___________.

James Zachry left a will, signed, January 20, 1790 and proven, March 8, 1790.

Georgia.

In the name of God amen.

I
James Zachry of the County of Richmond in the said State, being of perfect mind and memory, blessed be God for the same, do make, ordain and constitute this, my last Will and Testament, in the words of following Viz. In primus, I give and bequeath to my dearly beloved Wife Mary Zachry all the Tract of land I now live on, containing Two hundred acres, be the same, more or less, lying and being in the said County of Richmond on both sides of the Uchee Creek, together with all my personal estate consisting of Two Negroes named James and Sarah, with their future increase, Horses, Cows, Sheep and Hogs, farming utensils, and House-Hold goods except one feather bed, which shall be hereafter named, all during the natural life of my said Wife, subjected to the maintenance of my Daughter Betty, an Idiot.

SECONDLY - I give and bequeath to my Son William Zachry, his Heirs and assigns forever, fifty Acres of land, lying on the waters of the Uchee Creek which he now lives on being part of a Tract of Four hundred acres.

THIRDLY - I give and bequeath to my Daughter Mary Tinsly, Her Heirs and assigns forever, fifty Acres of land, being part of the said tract containing four hundred Acres. Also one hundred acres of land on Savannah River Joining lands formerly Saramours and Millers.

FOURTHLY - I give and bequeath to James Blackstone and John Blackstone, one hundred and fifty acres of land being the balance and part of the above mentioned Tract of Four hundred Acres of land that my Son William now lives on, and to their Heirs and assigns forever.

FIFTH LY - I give and bequeath to my Daughter Betty, one feather bed of furniture, and to her Heirs and assigns forever. Also should my Dear Daughter Betty Survive the death of my dearly beloved Wife, then and in that case, the said Tract of land and Negroes, already bequeathed to my said Wife shall be vested in her during her natural live.
SIXTHLY - After the decease of my said Wife and my Daughter Betty, I give and bequeath to William Yarbrough and James Yarbrough, all that tract of land that I now live on and already bequeathed to my said Wife and Daughter Betty, to be equally divided between them, Share and Share alike, and to their Heirs and assigns forever.

SEVENTHLY - It is my will of pleasure, that after the decease of my said Wife, all the personal estate then remaining ( except the two Negroes, James & Sarah already bequeathed ) to be publicly vended, and the monies arising therefrom to be equally divided among all my children, that is to say, John Zachry, Winifred Blackstone, James Zachry, deceased, William Zachry, Pelithal Adams, Mary Tinsley, Betty Zachry & Martha Yarbrough, share and share alike to them and their heirs forever. Likewise, after the death of my dearly beloved wife and dear daughter Betty, then Negroes aforesaid, are to be publicly vended and the monies arising to be equally divided among all my children, share and share alike, as aforesaid.

And lastly;

I do ordain, constitute and appoint my dearly beloved wife Mary Zachry my sole and entire Executrix, to receive all debts due, and to pay all Legal Demands against my estate, -- Given under my hand and seal the Twentieth day of January one thousand Seven hundred and Ninety.

Richmond County - Mirah McDonough and Daniel Elam being duly sworn, saith that they were present and saw James Zachry sign and seal the above instrument of writing and deliver it as his last Will and Testament for the purposes therein expresses that they believed the said James to be at that time of sound memory and that they together with Betty Ann Tindell subscribed their names as witnesses in the presence of each other and in the presence of the Testator. 8th March 1790
